Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and NotaryLink (“NotaryLink,” “we,” “us,” or “our”), governing your access to and use of the website located at gonotarylink.com and all related services (collectively, the “Service”).
By accessing or using our Service, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the Effective Date above and, where appropriate, by sending an email to the address associated with your account. Your continued use of the Service after any such changes constitutes your acceptance of the updated Terms.
2. Description of Service
NotaryLink is an online marketplace platform that connects mobile notary loan signing agents (“Notaries”) with title companies, escrow officers, signing services, and individual consumers (“Users”) seeking notary services.
NotaryLink provides the platform infrastructure only. We are not a notary service, a signing service, or a party to any transaction or agreement between a Notary and a User. NotaryLink does not employ notaries and is not responsible for the quality, timing, legality, or outcome of any services provided by Notaries listed on the platform.
3. User Accounts
3.1 Registration
To list your notary profile on NotaryLink, you must create an account by providing accurate and complete information including your name, email address, phone number, and professional credentials. You agree to keep this information current and accurate at all times.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@gonotarylink.com if you become aware of any unauthorized use of your account.
3.3 One Account Per Person
Each individual may maintain only one notary account on NotaryLink. Creating multiple accounts is prohibited and may result in termination of all associated accounts.
4. Notary Listings and Credentials
4.1 Self-Reported Credentials
All certifications, credentials, and professional information displayed on notary profiles are self-reported by the Notary. NotaryLink does not independently verify the accuracy of any credential, certification, background check status, errors and omissions insurance status, or any other professional information listed on the platform.
By listing credentials on your profile, you represent and warrant that all information you provide is accurate, current, and not misleading. You agree to promptly remove or update any credential that has expired or is no longer accurate.
4.2 Misrepresentation
Intentional misrepresentation of credentials or professional qualifications is grounds for immediate account termination and may expose you to legal liability. NotaryLink reserves the right to remove any profile it believes contains false or misleading information.
4.3 Profile Content
You retain ownership of all content you submit to your profile, including photos, biographical information, and other materials. By submitting content to NotaryLink, you grant NotaryLink a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with the operation and promotion of the Service.
You represent and warrant that you own or have the necessary rights to all content you submit, and that such content does not violate the rights of any third party.
5. Subscription and Billing
5.1 Free Trial
New notary accounts receive a 60-day free trial period beginning on the date of account creation. During the free trial, your notary profile will be visible on the platform and you will have full access to all features of the Service.
A valid credit or debit card is required at registration. Your card will not be charged during the free trial period. We will send you a reminder email approximately 2 days before your trial period ends.
5.2 Subscription Fee
Following the expiration of your free trial, your subscription will automatically begin at the rate of $7.00 per month (the “Subscription Fee”). You authorize NotaryLink to charge your payment method on file on a monthly recurring basis until you cancel your subscription.
The Subscription Fee is locked in at the rate in effect at the time of your initial subscription. NotaryLink may increase prices for new subscribers at any time, but will provide existing subscribers with at least 30 days advance notice of any price change affecting their account.
5.3 SMS Notification Add-On
Notaries may opt in to SMS inquiry notifications for an additional $1.00 per month (the “SMS Add-On”). The SMS Add-On will be added as a separate line item to your monthly subscription. You may enable or disable the SMS Add-On at any time through your dashboard settings. Disabling the SMS Add-On will take effect at the start of your next billing cycle.
By enabling the SMS Add-On, you consent to receive text message notifications from NotaryLink. Message and data rates may apply. You may opt out at any time by replying STOP to any message or by disabling the add-on in your dashboard.
5.4 Payment Processing
All payments are processed by Stripe. By providing your payment information, you agree to Stripe’s terms of service available at stripe.com/legal. NotaryLink does not store your full payment card information on its servers.
5.5 Failed Payments
If a scheduled payment fails, we will notify you by email and provide a 7-day grace period to update your payment information. If payment is not received within the grace period, your profile will be hidden from the platform until payment is made. Your account and profile data will be retained and your profile will be restored upon receipt of payment.
5.6 Cancellation
You may cancel your subscription at any time through your dashboard billing settings or by contacting us at hello@gonotarylink.com. Upon cancellation, your profile will remain visible on the platform through the end of your current billing period, after which it will be hidden. No refunds are provided for partial billing periods.
5.7 Refund Policy
All subscription fees are non-refundable except where required by applicable law. If you believe you have been charged in error, please contact us at hello@gonotarylink.com within 30 days of the charge and we will review your request.
6. Acceptable Use
You agree not to use the Service to:
- Provide false, inaccurate, or misleading information about yourself or your credentials
- Violate any applicable federal, state, or local laws or regulations, including those governing notarial acts in your jurisdiction
- Infringe upon the intellectual property rights of NotaryLink or any third party
- Transmit unsolicited commercial communications or spam
- Harvest or collect contact information of other users for any unauthorized purpose
- Interfere with or disrupt the operation of the Service or the servers and networks connected to it
- Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
- Use the Service for any unlawful or fraudulent purpose
NotaryLink reserves the right to investigate and take appropriate action against anyone who, in NotaryLink’s sole discretion, violates this provision, including terminating their account and reporting them to law enforcement.
7. Contact Inquiries
NotaryLink provides a contact form on each notary profile that allows Users to send inquiries to Notaries. By using this contact form:
- Users represent that their inquiry is genuine and made in good faith
- Users agree not to submit spam, fraudulent, or harassing messages
- NotaryLink acts only as a message relay and is not a party to any resulting engagement
NotaryLink rate-limits contact form submissions and reserves the right to suspend or restrict access to the contact form for Users who abuse this feature.
8. Title Company and Signing Service Users
Title companies, escrow officers, signing services, and other professional Users may access and search the NotaryLink platform at no charge. No account is required to search for and contact notaries. By using the platform, these Users acknowledge that:
- Notary credentials are self-reported and should be independently verified prior to engagement
- NotaryLink is not responsible for the performance, conduct, or qualifications of any Notary
- NotaryLink does not guarantee the availability or responsiveness of any Notary
9. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of NotaryLink. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of NotaryLink.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
NOTARYLINK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NOTARYLINK DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE PLATFORM, INCLUDING NOTARY CREDENTIALS AND PROFILE INFORMATION.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOTARYLINK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOTARYLINK’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO NOTARYLINK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless NotaryLink and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any third-party rights, including any intellectual property or privacy rights
- Any claim that your profile content or notarial services caused damage to a third party
- Any misrepresentation of your credentials or qualifications on the platform
13. Third-Party Services
The Service integrates with third-party services including Stripe (payment processing), Twilio (SMS delivery), Resend (email delivery), and Cloudinary (image storage). Your use of these services is subject to their respective terms of service and privacy policies. NotaryLink is not responsible for the practices or content of any third-party services.
14. Termination
NotaryLink reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include but are not limited to violation of these Terms, misrepresentation of credentials, abusive conduct toward other users, or non-payment of subscription fees.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered in Nashville, Tennessee in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
YOU AND NOTARYLINK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NotaryLink with respect to the Service and supersede all prior and contemporaneous agreements, representations, and understandings.
